GENERAL TERMS OF USE OF THE MINDBAZ WEBSITE

ARTICLE 2 : DEFINITIONS
GCU means the present General Terms of Use of the SITE
INTERNET refers to any person, client or not, having access to the SITE
SITE shall designate the Internet site www.mindbaz.com, operated by the company MINDBAZ
ARTICLE 3: PURPOSE
The purpose of these General Terms of Use is to govern access to and use of the SITE. These General Terms of Use may be modified according to the commercial environment in which the SITE operates and according to the regulations in force. Any modification of the General Conditions of Use will be published on the SITE with a mention of the date of the update.
ARTICLE 4: PROTECTION OF PERSONAL DATA OF INTERNET USERS
MINDBAZ, which is responsible for the processing, implements the processing of personal data of INTERNAUTES for the purpose of commercial prospecting.
In this context, it may collect: your e-mail address, your name, your first name for the time necessary to process your request.
This data is mandatory and essential to this prospecting. If you do not provide this information, your requests will not be taken into account, and your requests will not be answered.
The data collected is kept for the duration of the commercial relationship, or failing that, for a maximum of 3 months. The data collected is intended solely for the above-mentioned purpose.
During your navigation on the site www.mindbaz.com, cookies are collected via the Internet browser you use and record information relating to your navigation, in order to offer you improved navigation and proposed functionalities during your subsequent connections.
In accordance with the provisions of Law No. 78-17 “Informatique et Libertés” of January 6, 1978 as amended by Law No. 2018-493 of June 20, 2018, and the RGPD Regulation (EU) 2016/679 of the European Parliament and the Council of April 27, 2016, you have a right of access to data concerning you, a right to rectify or delete them, a right to limit the processing of your personal data, the right to portability of your data but also the right to object to the processing due to a particular situation and a right to object to commercial prospecting. ARTICLE 5: LIMITATION OF LIABILITY
MINDBAZ shall in no case be held liable to the INTERNET USER or any third party for any damage, direct or indirect, that may occur in connection with the use of the SITE, and in particular for the unavailability of the SITE, download delays, non-transmission of data, inaccessibility of the SITE, intrusions, data piracy, software and files contaminated by computer viruses.
The INTERNET USER acknowledges that he/she is aware of the nature of the Internet network, and in particular, of its technical performance, of the response times for consulting, querying or transferring information data, and of the vulnerability resulting from Internet access. The INTERNET USER remains solely responsible for the entirety of the operations carried out through the SITE, which he/she does at his/her own risk.
Consequently, the INTERNET USER takes all necessary measures to ensure that his or her means of connection allow him or her to use the SITE effectively and efficiently. In this respect, the INTERNET USER shall immediately inform MINDBAZ of any malfunction and/or failure encountered on the SITE, and undertakes not to disrupt the proper functioning of the SITE.
ARTICLE 6: INTELLECTUAL PROPERTY
The content of the SITE is an intellectual work within the meaning of article L. 112-2 of the CPI.
MINDBAZ is the exclusive owner of the industrial property rights as well as the copyrights related to the contents of the SITE. In particular, it holds the rights to logos, icons, images, photographs, videos, texts, graphics, software, sounds, plans, trademarks, various creations and protectable works, databases, etc.
It also holds intellectual property rights on all the products displayed on its SITE, including software that it develops. As such, any representation, reproduction or adaptation of all or part of this SITE by any means whatsoever and without its agreement constitutes an infringement of its rights and is strictly prohibited.
ARTICLE 7: HYPERTEXT LINKS
No hypertext link may be created to the SITE without the prior and express consent of MINDBAZ. If an INTERNET USER wishes to create a hypertext link from its site to the SITE, regardless of the medium, it must first contact MINDBAZ and obtain its prior written consent.
ARTICLE 8: APPLICABLE LAW – DISPUTE
These GTUs are written in French and subject to French law, regardless of the country of residence of the INTERNET USER, except for mandatory provisions to the contrary such as those arising from Regulation 593/2008 of 17/06/2008 known as Rome I.
The INTERNALIST has the possibility of resorting, in the event of litigation, to a conventional mediation procedure or any other alternative mode of settlement of the disputes. In the absence of an amicable agreement, the French jurisdiction will be the only competent one.
